By using ShiftSafe ("the App", "the Service"), you agree to be bound by these Terms of Service. Please read them carefully.

1. About ShiftSafe

ShiftSafe is a work shift tracking tool designed to help international students in Australia monitor their work hours in relation to their student visa conditions. The App is operated by Diego Auguin, an individual based in Sydney, New South Wales, Australia.

2. Important Disclaimer — Not Legal or Migration Advice

The information provided by ShiftSafe, including hour calculations, fortnight periods, and work limit information, is provided for general informational purposes only. You should not rely solely on ShiftSafe to determine your visa compliance. Always verify your visa conditions directly with the Department of Home Affairs or a registered migration agent.

We are not responsible for any visa breaches, cancellations, fines, or other consequences that may arise from your use of or reliance on ShiftSafe.

2A. Condition 8105 Compliance Tracking Disclaimer

ShiftSafe provides estimated compliance tracking based on publicly available information about Student Visa Condition 8105. This app does not constitute legal advice. The exact calculation method used by the Department of Home Affairs has not been officially confirmed in writing. Users are solely responsible for ensuring compliance with their visa conditions. Always verify your hours with your education provider and consult a registered migration agent if in doubt.

3. Eligibility

You must be at least 16 years of age to use ShiftSafe. By using the App, you confirm that you are 16 or older.

4. Free and Paid Services

ShiftSafe offers a free tier with limited features and a paid Pro tier with additional features. Features available on each tier are described in the App. We reserve the right to modify, add, or remove features from any tier at any time with reasonable notice.

5. Acceptable Use

You agree not to:

• Use ShiftSafe for any unlawful purpose
• Attempt to bypass usage limits or rate limiting systems
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in any way that could damage, disable, or impair our servers or networks
• Submit false, misleading, or harmful content to the AI assistant
• Attempt to manipulate the AI assistant to produce harmful content

6. AI Assistant (ShiftBot)

ShiftSafe includes an AI assistant powered by Anthropic's Claude API. The AI assistant is designed to help you manage your shift data. Please note:

• The AI assistant may make mistakes. Always verify important actions before confirming
• Destructive actions (deleting shifts) require your confirmation and cannot be reversed once completed
• The AI assistant does not have access to your visa details, immigration records, or government systems
• Free-tier users receive 15 ShiftBot messages per calendar month. Pro includes 50 AI messages per month. Hitting the AI cap never blocks core features (hours counter, calendar, alerts). These limits may change with notice

7. Data and Your Content

You own the data you enter into ShiftSafe. By using the App, you grant us a limited licence to store and process your data solely for the purpose of providing the Service. We do not claim ownership of your shift data.

8. Availability and Changes

We strive to keep ShiftSafe available 24/7 but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time. We will provide reasonable notice of significant changes.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, ShiftSafe is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App. Continued use after changes constitutes acceptance of the updated Terms.
